The Chippewa County Board of Commissioners met on Wednesday, January 2, 2013 at 12:00 noon in the Courtroom of the Chippewa County Courthouse for their Organizational meeting.

Present:  Commissioners Don Cooper, George Kinsella, Don McLean, Ted Postula and Scott Shackleton

Also Present:  Scott Brand, Debbie Sirk, Mrs. McLean, Emily McLean, Madison McLean, Jim Moore, Jesse Knoll, Deputy Administrator Kelly Church, Administrator Jim German and Cathy Maleport, Clerk

The Oath of Office was given by County Clerk, Cathy Maleport, to all newly elected Commissioners.

ELECTION OF CHAIRMAN

The County Clerk called for nominations for the position of Chairman.

It was moved by Commissioner Kinsella, seconded by Commissioner Postula, to nominate Scott Shackleton for Chairman.

Nominations were called for three times. Hearing no further nominations, the Clerk declared the nominations closed.

It was moved by Commissioner Kinsella, seconded by Commissioner Postula, that a unanimous ballot be cast for Scott Shackleton. On a voice vote, the motion carried.

VICE-CHAIR

Chairman Shackleton proceeded and called for nominations for the position of Vice-Chair.

It was moved by Commissioner Cooper, to nominate Don McLean.

It was moved by Commissioner Postula, to nominate George Kinsella.

Nominations were called for three times, hearing no further nominations, a roll call vote was taken as follows:

Commissioner Cooper:      Don McLean
Commissioner Kinsella:     George Kinsella
Commissioner McLean:     Don McLean
Commissioner Postula:     George Kinsella
Chairman Shackleton:      George Kinsella

Commissioner Kinsella was voted as Vice-Chairman of the Board by a vote of
3-2.

 Chairman Shackleton then addressed the Bylaws and Rules of Procedure and pointed out the following two things:

  • He did change the language to say that the meeting place shall be in Circuit Court or whichever place is indicated when the Public Notice is published as that would give them the flexibility to look at the New District Court or perhaps Probate Court; and  
  • The meeting time was left blank in the Bylaws and Rules of Procedure as he could not identify a consensus from the Board Members as to what they would like for a meeting time.

It was moved by Commissioner McLean, seconded by Commissioner Postula, to adopt the By-Laws as presented.

Amendment to Original Motion to include a 6:00 p.m. meeting time
 
It was moved by Commissioner McLean, seconded by Commissioner Cooper, to set the Regular Board meetings at 6:00 p.m. A discussion ensued.

On a voice vote:

Ayes: Commissioners Don Cooper and Don McLean

Nays: Commissioners George Kinsella, Ted Postula and Chairman Shackleton

The motion failed by a vote of 3-2.

It was moved by Commissioner Kinsella, seconded by Commissioner Postula,              to set the Regular Board meetings the same day of the month changing the time to 2:00 p.m. in the afternoon. A discussion ensued.

On a voice vote, the motion carried with Commissioner Cooper voting Nay.

Having no further amendments to the original motion to adopt the By-Laws and Rules of Procedure, a voice vote was taken as follows:

Ayes:  Commissioner Kinsella, McLean, Postula and Chairman Shackleton

Nays:  Commissioner Cooper

The motion carried.

It was moved by Commissioner Cooper, seconded by Commissioner McLean to adopt the meeting schedule as presented. On a voice vote, the motion carried.

NEW BUSINESS:

Appointments to various Boards, Committees and Agencies

Chairman Shackleton noted that they’re two sets of appointments to be made,   one of which are the Boards and Committees, the other are the actual County Commission Committees. He further noted, that they have adopted in their Rules of Procedure, a revised Committee arrangement in which they streamlined several committees into two as follows:

  • Building Grounds and Jail; Legislative and Natural Resources; and Information Technology;   all were separate committees - now one.
  • Personnel; Equalization & Apportionment; Transportation; and Health and Social Services, all were separate committees - now one.

This will help streamline our process, better accommodate five Commissioners rather than seven and will be a financial savings because of fewer meetings.

Chairman Shackleton then made the following appointments:

Chairman Shackleton stated that there was discussion that he would like to acknowledge regarding the Mental Health Board, that they can look into that further, but it was brought to his attention that under the Mental Health Code, which is state law, all appointments to the Mental Health Board are three year appointments. “I do not believe, at this time, I have any vacancies to make appointments too on that Board. If someone can demonstrate that this is incorrect, then we can take it up at the next Commissioner’s meeting.”

Public Comments:

Mrs. McLean addressed her disapproval of former Commissioner, Jim Moore, remaining on the Mental Health Board.

Commissioner Comments:

Commissioner McLean stated that when you look at the membership on the HBH Board, the membership of each of the counties has changed almost completely; except for Schoolcraft County; that possibly, Mr.  Kinsella and Mr. Moore can approach HBH and ask them not to fill that County Commissioner until this rolls around and a position becomes open and   we can refill it.

Chairman Shackleton noted that he is certainly aware of Chippewa County’s past practice and of both the law and bylaws which give Chippewa County the ability to have two Commissioners.

Commissioner Cooper added that he believes HBH merging with them in the beginning   was a mistake; we have always been under-represented.

Commissioner Cooper added that he would like to call the Finance meetings to be at 5:00 p.m. on the above days listed.

Having completed the agenda items, it was moved by Commissioner Kinsella,
seconded by Commissioner Postula, to adjourn. On a voice vote, the motion carried and the Board did adjourn at 12:50 p.m.
