Priority for making funeral and burial arrangements is determined by making reference to the order established for intestate succession, i.e., spouse, children, parents, siblings, etc.

If no next of kin can be found, the authority falls to either the decedent's guardian or the county public administrator.

 

If there is a disagreement among heirs regarding the dispostion of the deceased in which two or more heirs have equal priority, a petition is filed and a hearing is held within seven (7) days.
